刑法第63条第二款之“案件的特殊情况”认定

为了实现刑罚的个别化和量刑的轻缓化,我国刑法的酌定减轻处罚情节规定具有必要性和合理性。酌定减轻处罚情节中的案件的特殊情况包括政策性特殊情况和情节性特殊情况。在认定上,政策性特殊情况从打击犯罪的需要和社会普世价值两方面考虑;而情节性特殊情况则应考虑法益侵害性、非难可能性和预防必要性三要素。在适用时应先考虑情节性特殊情况,再考虑政策性特殊情况,以确保案件认定上的准确性。

Identification of The Special Circumstances of The Case in The Second Paragraph of Article 63 of The Criminal Law

In order to realize the individualization of penalty and the mitigation of sentencing,it is necessary and reasonable to stipulate discretionary mitigated punishment circumstances in our criminal law. The special circumstances of the discretionary mitigating punishment include ＂the special circumstances in policy＂ and ＂the special circumstances of the case plot＂. While being recognized,the special circumstances in policy need to be considered on the following two aspects： the necessity to fight crimes and the common social values; as to the special circumstances of the case plot,the infringement of legal interests,the possibility to be blamed and the necessity of prevention are to be taken into account. For the sake of the accuracy in recognizing the cases,we should first consider the ＂special circumstances of the case plot＂,and then consider special circumstances in policy.
