| 摘 要： | 我国职务犯罪侦查权的监督制约机制分为内部制约和外部监督两部分,从形式上看较为完备,但实践运作中却存在许多问题,因此进一步完善我国职务犯罪侦查权的监督制约十分必要.当前应以职务犯罪侦查流程为主线,强化内外监督制约的效力,并对职务犯罪侦查活动实行动态监督.同时还需保障犯罪嫌疑人的诉讼权利,强化律师的辩护权,完善同步录音录像制度,建立责任奖惩制度.

| Abstract: | The supervision and restriction mechanism of China＇s duty crime detection power is comparatively perfect nowadays, but many problems still exist. Thus, it is of great significance to make further improvement on such supervision and restriction system. Dynamic supervision can be enforced in the process that based on the career crime investigation and intensifying internal and external supervision at the same time. Moreover, measures should be taken to guarantee the rights of the suspect and intensify lawyer＇s right to defense, improve system of synchronous recording and establish re- sponsibility system of rewards and punishments. |
