违约精神损害赔偿之可预见性规则的构建

可预见性规则是限制违约损害赔偿责任范围的重要工具。目前我国司法实践中涌现的违约精神损害赔偿案件愈来愈多,"违反可预见性规则扩大化适用违约精神损害赔偿"的背后凸显出传统合同法上的可预见性规则与违约精神损害赔偿理论的难以兼容性,从"预见主体"、"预见时间"、"预见内容"、"预见标准"四个方面有针对性地构建违约精神损害赔偿框架下的可预见性规则成为必然。

Construction on Rules of Reasonable Foreseeing in Mental Distress Compensation for Breach of Contract

The rules of reasonable foreseeing are one of the important tools in limitation of liability on distress com- pensation for breach of contract. At present, mental distress compensation for breach of contract case emerged more and more in our country judicial practice, behind ＂expansion application of mental distress compensation for the violation of the rules of reasonable foreseeing＂, which highlights the rules of reasonable foreseeing and mental distress compensation for breach of contract on the theory incompatibility from four aspects such as ＂the subject of foreseeing＂, ＂the time of foreseeing＂, ＂the content of foreseeing＂, ＂the stand of foreseeing＂, targeted to build rules of reasonable foreseeing under the framework of mental distress compensation for breach of contract becomes inevitable.
