试论互联网上国际知识产权纠纷的管辖权

首先阐明了互联网特性和知识产权特性之间的矛盾引发出国际知识产权纠纷的管辖权冲突,然后分析论述了互联网的全球性扩张对国际知识产权纠纷管辖权的确定带来的困难和问题。为了解决这些问题,初步提出了对我国近期的立法建议和对管辖权国际统一的展望,以期最终达成一个《互联网上国际知识产权纠纷管辖权公约》。

Tentative Discussion on the Jurisdiction in the Dispute about International Intellectual Property on the Internet

First,this paper interprets that the contradiction between the characters of the Internet and intellectual property results in the conflict of the jurisdiction in the dispute about international intellectual property.Then,it analyses and expounds the difficulties and problems in the determination of the jurisdiction in the dispute about international intellectual property brought by the global expansion of the Internet.In order to settle these problems,the author preliminarily puts forward her recent suggestions of Chinese legislation and the prospect for the international unification in the jurisdiction,and suggests reaching a Convention of the Jurisdiction in the Dispute about International Intellectual Property on the Internet finally.
