| 摘 要： | 通过网络视频的“裸聊”行为作为社会中的新生事物，在刑事法治的当今社会需要对其性质进行全方位的权衡与思量。就现今的刑事立法来看，法律的缺位注定了“裸聊”行为在罪刑法定原则之下难以入罪：从伦理道德的评判视角来看，伦理与法治张力的缓和决定了不需要把“裸聊”行为作为犯罪处理。
