论反垄断法对经营者集中的规制

依据《反垄断法》的规定，中国对一定门槛规模以上的“经营者集中”采用了事前强制申报的制度，并赋予反垄断执法机构直接处理的实质性权力，但许多细节和具体操作问题仍待补充。本文从审查原则、门槛设置、事前申报程序、审查标准、救济措施五方面，对经营者集中的反垄断规制提出了细化和完善的建议。

Anti-monopolistic Control on Concentration of Undertakings

According to the Anti-monopoly Law,China has adopted a mandatory beforehand notification system for Concentration of Undertakings above certain threshold,and substantive deciding powers are granted to the antimonopoly execution authorities.However, many complementary details still need to be discussed.In this article,the author raises some suggestions in order to subdivide and improve the related regulations from five different sides：principles for review,threshold setting,beforehand notification procedure,substantive review standards and remedy.
