| 摘 要： | 我国《保险法》所确立的“法律利益原则”同样适用于海上保险。对此 ,本文对比研究了“法律利益原则”与“经济利益原则”的优劣 ,指出了前者的缺陷及在我国海上保险中采用“经济利益原则”的合理性、必要性和可行性 ,认为在我国海上保险中应确立经济性保险利益原则。

| Abstract: | The principle of legal interest, which is established by Insurance Law of the PRC, may equally be applied in marine insurance. Considering the above, this paper compares the principle of economic interest with the principle of legal interest, points out the disadvantages of the latter and considers that the former should be applied in Marine Insurance, which is rational, necessary and feasible. |
