| 摘 要： | 罪犯权利按其形态可分为道德权利、法定权利和现实权利。法定权利是指国家法律制度所规定的权利 ;而现实权利是指罪犯实际所享有的权利。从历史的视角来考察中国罪犯的权利状况 ,本文把中国罪犯权利的发展进程分为罪犯无权利时期、罪犯权利萌芽时期和罪犯权利发展时期三个阶段。

| Abstract: | The prisoners' rights, according to its form, can be divided into moral rights, legislative rights, which refer to the rights from the state law and system, and the real rights, which refer to the rights the prisoners really have. From the historical angle, we can divide the developing history into three parts: the period in which the prisoners have no rights, in which the rights are growing, and in which they get developed. |
