WTO与中国环境保护法律制度的适应性变革

中国成为WTO正式成员的事实意味着WTO的原则和规则在中国必须得到严格的遵守 ,意味着中国必须变革其环境保护法律制度以适应WTO原则和规则的要求。WTO对各国环境保护法律制度的一般要求和对中国环境保护法律制度的特殊要求 ,促使中国环境保护法律制度进行适应性变革。中国的环境保护法律制度总体上是可以与WTO原则和规则的要求接轨的 ,我国应建立环境保护法律制度体系及应采取适应性变革措施。

WTO and Adaptable Innovation to China''''s Environmental Legal Systems

The fact that China has become the formal member of WTO means that principles and rules of WTO must be complied strictly by China and that environment protection legal system should be transformed by Chinese government so that it can be fitted to the demands of principles and rules of WTO.For one thing,the author analyses the common demands upon all members and special demands on China.For another,the author sets forth the theoretical and practical necessity of innovating environment protection legal system.Based on this discussion,the author reasons the theoretical and practical adaptability of Chinese environment protection legal system.It is proved that Chinese environment protection legal system can meet with the demands of principles and rules of WTO.In end of this article,two topics about the environment protection legal system economy that we should constitute and the primary adaptable innovating measures that we should adopt are discussed.
