经济法的社会利益考辩

本文试图提供这样一种分析的框架:将社会利益置于干预者、社会利益与个体成员的三元维度之中,考察社会利益如何在干预者与个体成员的互动博弈中获取生存空间,进而从社会利益与个体利益的关系中推出本文对社会利益的基本界定;这一界定将社会利益看成不确定多数个体利益相互平衡、协调的产物;这种解读与经济法界域下实质正义的思想恰可相互佐证。

Social Interests in Economic Law

This paper attempts an analysis of the framework in which social interests, interferers and individuals form a ternary relation. It is observed how social interests survive in the fierce competition of interferers and individuals. Thus, from the relation between social interests and private interests, this paper delineates the ambit of social interests. By this delineation, social interests are deemed as a balance and reconciliation of the private interests of undetermined major individuals. Such a presumption is identical to the idea of substantial justice in economic law.
