| 摘 要： | 1931年11月，中华苏维埃共和国临时中央政府成立后，中共首次在局部执政区域为维护和保障苏维埃公民的生存权、发展权、平等权作出了不懈努力并取得了卓著的成就，这是中共捍卫中国人权的历史见证。尽管这一时期颁布的法律文献没有出现“人权”一词，但其对苏维埃公民提供的人权保障是真实的、具体的。毋庸讳言，苏维埃人权建设保障是不完备的，也存在历史的局限性，正确总结中华苏维埃共和国人权建设之经验教训，对新世纪构建人权保障有诸多启示。
