| 摘 要： | 关于共犯的属性,国内外刑法学界存在着"共犯独立性说"、"共犯从属性说"和"教唆犯二重性说"之间的聚讼。但是,由于错误地理解了行为的概念进而错误地诠释共犯的属性,导致现有的共同犯罪理论存在着巨大的理论和现实困境。实际上,共犯并非只具有现有共同犯罪理论所坚持的"从属性",而应当是"独立性"和"从属性"两重属性的有机统一。在这两重属性中,共犯以"独立性为主、从属性为辅"。

| Abstract: | As far as the character of the accomplice is concerned, there is a wide spectrum of opinions on the standpoints such as the theory of＇independence of complicity, the theory of subordinate of complicity and the twoness of the abetter at home and abroad. However, the existing theory on the joint-crime faces the tre- mendous difficulties because of the misunderstanding about the act and the character of the accomplice. In fact, not just as the existing theory on the joint-crime insists on the subordinate of abetter, accomplice＇ s attribute is the integrity of independence and subordinate, among which priority shall be given to the independence. |
