| 摘 要： | 分裂国家是危害国家安全的严重犯罪,古今中外均将分裂国家的行为予以入罪并配以重刑。中外刑法的反分裂立法有其共同性,但也有显著差异。我国现行立法法定刑结构科学合理,但对分裂行为的规制不够合理,完善现行立法应拆解现有罪名、进一步明确罪状、将组织、领导、参加分裂国家组织行为单独“入罪”,从而重构分裂行为的刑事立法。

| Abstract: | The fission country crime is a serious crime to endanger national security. There is not only consistence but also difference between our country and abroad. In our criminal law, the construction of the crime is much more reasonable but lack of proper stipulation. As to perfecting the current legislation, it is thought that we should reorganize the current norms and make its connotation more clear. |
