Through the review on legislative evolution and judicial practice of the principle of bona fides,this article holds the view that this principle,which has been established widely in the civil law system,should be understood from tow aspects:judicial activity and good faith.Scholars should not pay much attention on the definition of bona fides.However,they should focus on summary of jurisprudence and the classification of good faith in substance.Meanwhile,research should be made on draw a line between judicial activity and discretionary in procedure.
