我国《公务员法》的创新及思考

摘    要:《中华人民共和国公务员法》的颁布实施,反映了我国人事制度改革和公共行政改革的趋势,较之于1993年国务院颁布的《国家公务员暂行条例,》完善了公务员的分类管理制度及晋升制度,规定了“两结构”的工资制度;增加了对廉的考核,加大了对聘任制的重视力度;提供了司法救济,强化了公务员的责任行政意识。这些创新适应了我国干部人事的实际情况,但仍有值得我们进一步思考的地方。

Abstract:Civil Servant Law of People's Republic of China formally put into effect on New Year's Day in 2006.It arouses a lot of dispute before it formally being promulgated.However,it reflects the tendency of reforming on personnel matters institution and public administration.Comparing it with Temporary Regulation of National Civil Servant issued by State Council in 1993,it improves the civil servants' classific administration and promotive institution.Civil Servant Law sets "two structures" salary system,adds the assessment of decent administration,attaches importance to the system of appointment,provides judicatory procedure and consolidates the responsible administration.These innovations are positive because they are suitable to Chinese personnel cadre practice.However,there are still some issues need to be further discussed.
