| 摘 要： | 我国一些学者认为《法国民法典》的侵权行为一般条款是第1382条,第1383条是对第t382条的补充,而第1384条是对准侵权行为的概括性规定。这一评介存在明显错误。实际上,第1383条才是《法国民法典》有关准侵权行为的一般规定。

| Abstract: | In China, some scholars hold that the general provision of delict stipulated in French Civil Code is Article 1382. Article 1383 is the supplement to Article 1382, and Article 1384 is the generalized (summarized) provision of quasi-delict. This comment is totally (obviously) wrong. In fact, unintentional delict stipulated in Article 1383 is the general provision of quasi-delict in French Civil Code. |
