我国农村土地家庭承包经营权的权利主体探究

家庭承包是农村土地承包经营中非常重要的一种方式,家庭承包经营权的权利主体是集体经济组织成员还是农户直接影响到了该权利的利益归属以及存续过程中的权利变更。结合我国农村历史发展状况和现行法律的立法目的,应该明确家庭承包经营权的实质权利主体应为集体经济组织成员,该权利具有成员权的属性,是农村集体经济组织成员人人平等享有的权利,农户只是家庭承包中的形式主体。

Research on the Subject of Contractual Management Right on Household Basis

Household contract is an important form of land contractual management in rural areas.The subject of contractual management right on household basis has influenced the profit ownership of the right and the alteration of the existing right.Considering the countryside history development condition and the legal goal of the law in effect,we confirm that the substance subject of the right of household contractual management shall be member of collective economic organization,and this right has nature of right to membership,which is enjoyed by every member of the collective economic organization.The farm family is only a formal subject of household contract.
