| 摘 要： | 17年前颁布的《治安管理处罚条例》在经历1994年的修订后,今天又走进全国人大常委会审议的视野。这些年我国的巨变对这部“老龄化”的《治安管理处罚条例》提出挑战。文章对正在审议中的《治安管理处罚法(草案)》进行分析,指出在立法目的、法律责任追究、公安机关适法选择、权力权利设计、与其他法律衔接等方面存在的不足。
