| Abstract: | The value of law is the logical origin of the existence of law, and also the guide to correct the evil law and promote the progress of the rule of law. The value framework of ecological compensation system includes purpose value and instrumental value. The purpose value is the inner soul, while the instrumental value is the external form. The purpose value of ecological compensation system includes environmental equity, justice and order. Its purpose is to realize the reconstruction and balance of interests among the stakeholders of ecological environment, and realize the continuous increase of ecological interests by establishing the priority of environmental equity. Among the instrumental values, the confirmatory value is embodied in fixing the objective value of ecological compensation in the form of system, so that it has the force of law; the distributive value is embodied in distributing the rights and obligations of ecological subjects, so as to realize the rule of law principle of equal rights and responsibilities; and the normative value is embodied in the implementation mechanism of ecological compensation system. |
