| 摘 要： | 考释中国古代贪赃、官盗、民盗等罪名与刑罚,审视现行刑法中的贪污、盗窃罪名与刑罚。比较古今:古严惩官贪,宽治民盗,今则严惩民盗,宽待官贪。传统的立法经验大有借鉴的意义,现行刑法极有修改的必要。

| Abstract: | According to explain the meaning of officials' corruption,the officials thieves,ordinary thieves and other criminal charges and penalties in ancient China law,we compare their different criminal charges and penalties between the Penal Code and ancient time law.We get conclusion that ancient time is better than now in the ways of seriously punishment to the officials' corruption and largeminded in ordinary thieves.The experience of tradition legislative is greatly using for reference of today's Penal Code legislative.We hold our points that the current Penal Code is very necessary for being changed. |
