法理学研究什么--从当前中国实践看法理学的使命

当前中国法理学有三种研究倾向,一种是启蒙(价值)倾向的法理学,一种是注释倾向的法理学,第三种是实证(规律)倾向的法理学.其中,第三种倾向是与法理学作为一门研究法律现实运作和演变规律的科学的性质相吻合的.否定法理学的科学性质,反而容易使它走上虚无主义的歧途.中国法理学当前要着重研究四个方面的规律研究世界范围内的法律演进的普遍规律,研究普遍规律支配下的中国法律演进的特殊规律,研究影响和制约法律运行的现实规律,研究依然影响现实法律的历史规律.就价值问题而言,法理学对中国法律未来的关注应该从对目标的价值论证转向对目标与路径的实证研究,研究多数人的目标选择及影响目标选择的复杂因素,而不是要代替人们选择法治目标及道路.

On the Missions of Jurisprudence

At present, there are three jurisprudence research tendencies in China: value jurisprudence, annotation jurisprudence and positive jurisprudence. Among them, the third is coincided with the scientific nature that the jurisprudence is a science of studying practical operation and evolvement of law. The Chinese jurisprudence should stress on four aspects of research: the general laws of world legal evolvement, the special laws of the Chinese evolvement, the actual laws that influence the operation of laws and the historical laws that influence the actual laws. As for the value problem, the future Chinese jurisprudence should pay more attentions to the positive study of goals and ways, the goal selections of the most people and the complex factors that influence the goal selections.
