| 摘 要： | 《公务员法》第54条规定了公务员下级执行上级的决定或命令时上下级之间的职责关系,成为一大突破和亮点。但由于该文立法的模糊性和原则性,导致了内容缺乏操作性,甚至与权责一致原则相违,因此,需要从行政法中的权责一致原则角度出发加以修订和完善。
