清末就地正法制度研究（上）

就地正法的产生是清代后期法律制度重大变化。以往学者对于就地正法与清前期的恭请王命即行正法制度的关系认识不甚深入，对于就地正法之制的研究也主要集中在于中央和地方权力关系的变迁。对此，应当坚持新历史法学的研究路径，从就地正法的产生、就地正法的实际操作、关于就地正法的争论、就地正法在晚清无法取消的原因等方面对其合法性进行解读，从而解释法律、资源与时空建构的复杂关系。

On Jiudizhengfa System of the Late Qing(Part One)

The emerging of Jiudizhengfa is the tremendous change for the legal system in late Qing Dynasty.The former scholars’ understanding regarding the relationship between the system of Jiudizhengfa and the system of Gongqingwangmingjixingzhengfa during the earlier period of the Qing Dynasty is really not thoroughly,their research also mainly centers on the vicissitude of the relations between central government and local authority.The author persisted in New Historical Law research approach,and analyzed the emerging of Jiudizhengfa,the actual operation of Jiudizhengfa,the debate about Jiudizhengfa,the reason which is unable to cancel in the latter Qing dynasty,the explanation to Jiudizhengfa from the angle of legality.Exploring the complex relations of law,resources and space-time construction.
