An Overview on the Legal Essence of Parallel Importation

The issue of whether or not parallel importation constitutes a tort has become a hotspot in the field of international protection of intellectual properties. The essay intends to focus on the survey of the theoretical basis of parallel importation, analysis of the attitudinal views of TRIPS over the issue of parallel importation as well as the legislation and practice of major western countries concerning this issue, discussion of the existing legal system and status of economic development of our country, on the basis of which the author puts forward the point of view that our country should not take an over-severe attitude toward the parallel importation.
