摘    要:农地流转制度逐步确立和深入推行之后,随之而来的纠纷势必增多,农地流转纠纷能否得到高效及时的化解事关我国新一轮土地政策的成败。检视我国农地流转纠纷仲裁解决机制的现状,结合试点实际情况,反思仲裁中尚存的问题和不足之处。透视农地流转纠纷的激增给仲裁带来的巨大挑战和考验,从制度规范、组织运行及外部环境优化等层面搭建公正高效的仲裁解决机制。通过举证责任倒置、巡回仲裁庭、多元联动执行等制度创新,提出切实可行的具体对策,完善农地流转纠纷仲裁机制,为我国新一轮土地政策的推行铺平道路。

Abstract:As the policies of circulation of agricultural land are gradually established and further implemented, more and more disputes of the agricultural land appeared. Whether the disputes can be resolved efficiently in a timely manner determines the success or failure of the new policies. Based on investigation of the arbitration mechanism, the article examines the problem and defect of the existing arbitration system in rural area, analyses the challenges carried by the circulation of agricultural land and low to build a fair and efficient arbitration mechanism from the construction of norms, organization and operation, optimization of the external environment. By the way of creating the circuit court and invertion of the proof burden,we apply specific and practical measures to improve the existing arbitration mechanism, with the purpose of paving the way for implementation of the new policy.
