安全保障义务的法理依据

安全对于现今这个经济高速发展的社会来说愈发显得重要,在享有安全保障权利和行动自由权利的权衡中,现代侵权法偏向了安全保障。安全保障义务实际上已经构成了公共秩序的有机组成部分。当我们在旅行、餐饮、娱乐等经营场所中活动或者参与其他社会活动时,常常会遇到来自自身或者第三人的危险,从而遭受不同程度的人身伤害或财产损失。我们在强调对自己行为负责以及要求第三人对其行为负责的同时,也要看到这些经营场所或社会活动场所对参与到其中的参与人负有一定的安全保障义务,即保障他们的人身和财产不受侵害。安全保障义务的价值也即体现在此。
