| 摘 要： | 多年来在企业发生的有关重大伤亡事故的犯罪,有一部分属于故意犯罪。但由于过去法律一直按过失犯罪处理,法定刑期比较轻,因而客观上纵容了一些经营者追求巨大利润而忽视职工的生命安全的行为。河南省高级人民法院近以“故意犯罪”惩处平顶山市“9．8矿难”的犯罪人,这对今后分清企业重大伤亡事故的犯罪性质,保护职工生命安全,具有重要的标本意义。

| Abstract: | There are many criminal cases happened in the enterprise recent year,and part of them were intentional crimes.However,they were considered as criminal negligence by the past law that led to a light punishment.Therefore,some businessmen were apt to ignore the employees' lives to pursued large benefits.Superior people's court of Henan judge the offender as a intentional crime in the mine disaster in Sep.eighth in the city of Pingding.It is significant for the employees to distinguish the character of the big ... |
