对我国刑法伦理维度的思考

刑法在一国法律体系中占有举足轻重的地位,是保障性法律。伦理精神是刑法内容的体现,把握刑法与伦理的合理维度是当前刑法研究的重要课题。在当前刑法是否能够伦理化的讨论中必须深入理解刑法与伦理的关系,把握好刑法的伦理维度。我国刑法伦理维度的设定任重而道远,必须寻求刑法与伦理、市场经济与社会公正的最佳均衡点,更新人们的刑法理念,建构与社会主义制度相适应的刑法伦理维度。

Discussion on Ethical Dimension of Criminal Law in China

Criminal law plays a decisive role in a country’s legal system,which is the indemnificatory law.Ethical spirit is the embodiment of the content of criminal law.It is an important research issue of the current criminal law to grasp the reasonable dimension of criminal law and ethics.The relation between criminal law and ethics must be understood deeply and ethical dimension of criminal law must be grasped well in the discussion of whether the current criminal law can be ethicized.There is a long way for the setting of ethical dimension of criminal law,which demands the best equilibrium point between criminal law and ethics,market economy and social justice,refreshment of people’s ideas on criminal law and building ethical dimension of criminal law which adapts to socialism system.
