| 摘 要： | 程序正义是程序尤其是司法程序设计和运作中所应体现的正当性，它具有不同于实体正义的独立价值。程序正义的理论基点和深层内涵不在于程序本身，而在于个人的权利。通过程序设计以权利制约权力乃是程序正义的题中应有之义，也是实现程序正义的必要途径。

| Abstract: | Procedural justice is the reasonableness and legitimacy embodied in the course of the designing and operating of procedure,especially judicial procedure.Procedural justice has its own value independent of substantial justice.The author concludes that checking power with right by means of procedure is an inborn character of procedural justice,as well as a necessary channel for the realization of procedural justice. |
