论民间法语言的模糊性

民间法语言的模糊性具有普遍性,其成因具有多元化特点。民间法语言的模糊性既有扩大民间法规范的解释力、促进民间法规范效力的实现、形成与国家法语言的互补等积极作用,也有消极影响规范的指引作用、为社会权力滥用提供方便、不利于民间法文化塑造等消极作用。面向现代社会的民间法应该在追求语言精确性的基础上,恰当运用语言的模糊性。
