试论我国专利产品平行进口的立法规制

各国对国际贸易中专利产品平行进口的法律规定分歧较大,我国专利法对此无明确规定。从经济与法律两个层面分析,允许平行进口短期内有益于进口国的消费者;长远地看,会对发展中国家吸引外资和专利技术产生不利的影响。我国专利法以禁止专利产品的平行进口为原则,同时规定专利产品合法地平行进口所适用的情形。

On the Program of Legislation of Parallel Import of Our Country''''s Monopoly Product

Various countries have different law provisions of the parallel import in international trade.Our country' s law of patent has no clear enactment about this.Analysing from the economy and law,permitting parallel import in short time will benefit the customers of import country;but from the long-term point of view,it will product some harmful affects on absorbing foreign capital and patent technique in developing countries.Our country' s law of patent takes the prohibition of parallel import of patent product as principle,and meanwhile,establishes some situations of importing patent product legally.
