我国慈善立法中的政府与慈善组织的关系

慈善事业作为社会保障的重要部分在建设和谐社会中发挥了不可取代的作用.在中国的慈善组织发展中,其"官民二重性"的显著特点一直是其发展中的诟病,而中国慈善事业法律制度的不健全成为其发展中的最大障碍.由此,政府与慈善组织的关系是中国慈善立法需要解决的关键问题.因此应当通过制定统一的<慈善事业法>,改革慈善组织的相关制度,加快配套法律制度的建设,为我国慈善事业的发展提供完善的法律保障.
