农民土地权益保护存在的问题及对策分析

土地农转非速度很快,农民土地权益得不到充分的保护,是我国经济发展中面临的一个重要问题。究其原因,与相关法律规范不完善、政府行为失范、村民代表会议和村民会议制度的操作性差等因素有着密切的关联性。为此,应当通过立法明确和完善农民的土地权益,并通过程序设计加以保障;依法控制和约束政府权力,促进政府依法行政;修改《村民委员会组织法》,完善村民会议制度和村民代表会议制度;建立农民土地权益的保护机制。

The speed of the village land turning to non-village land is very quick,rights in the farmer land can not get a full protection,this is an important problem that we face in our country development.Investigating its reason isn't perfect with related law norm,the government administration behavior loses norm,village people representative the operability of the meeting and village people meeting system is operability badly have a close connection.For this,we should definite with the land rights of perfect farmer by making the law,and take in to guarantee through a program design;Control peace treaty to tie a government power by law,promote a government by law administration;Modification village people committee organic law,perfect system and village people of the village people meeting represent meeting system;The protection mechanism which builds up rights in the farmer land waits,etc.
