论国际法在国际秩序中的作用

自17世纪初现代国际法产生以来,国际法在威斯特伐利亚模式的国际秩序发展变化中起着积极的作用。国际法在国际秩序中的作用可从三个角度进行分析：其一,从国际法理论的变化角度分析国际法在规范国际秩序中的作用;其二,从国际组织的国际法编纂或制定角度分析国际条约法在战后国际秩序的建立和变化中的作用;其三,结合当代国际秩序中的战争与和平以及可持续发展的重大问题,分析国际法与国际政治经济的互动作用。由此,可从国际法角度探求面向未来国际秩序变化的中国立场。

On the role of the International Laws in the International Order

Since the generation of modern international laws in the 17th Century, and in the development of the international order according to the Westphalia mode, the international laws have played positive roles, which can be analyzed from three aspects: firstly, the normative roles from the perspective of the change of international law theories; secondly, the role of international laws on treaties in establishing post-war international order from the perspective of the compilation and stipulation of international laws sponsored by international organizations; thirdly, the interactive roles of the international law and the international politics and economy in light of major issues on war, peace and sustainable development in the modern international order. Further, China’s stance in the future international order can be explored from the perspective of the international laws.
