银行不良资产处置的法律环境

我国银行不良资产处置的法律制度存在较多的问题,为了更加有效地处置银行不良资产,我国应该尽快制订高层级的立法,健全实施多种不良资产处置方式的法律支持环境,尽快建立存款保险制度,实现不良资产管理和商业性处置机构的分离,赋予债权人对债务人特殊的强制性权利,成立特别法院负责对银行不良资产案件进行审理,建立银行不良资产的估价制度。

Comparing with the perfect legislative supporting environments established for bank non-performing assets disposition in the USA, Poland and Malaysia, there are still a lot of problems in our legal system in the field of bank non-performing assets disposition. To dispose non-performing assets more effectively, referring to foreign relevant legal system, we should firstly make high-level law; secondly, perfect and set up legislative supporting environments for multiple non-performing assets disposition patterns; thirdly, establish deposit insurance system at an early date; fourthly, separate non-performing assets management institution from commercial disposition company and meanwhile, vest compulsory right in creditor; fifthly, establish special court to handle non-performing assets cases and finally, set up a non-performing assets valuation system.
