| 摘 要： | 我国权力制约乏力的历史成因是国家权力获取方式;制度成因是权力过分集中;现实成因是监督信息传递不畅;法治成因是法制不健全和执法无力;组织成因是监督制约机构独立权威性不强。权力制约有效的首要条件是保证权力监督信息渠道自由通畅;必需条件是保证权力制裁权的科学合理配置;必要条件是保证权力运行在法制轨道上。

| Abstract: | The historical reason of the weak supervision of power in China is the way to get the state power, the systematic reason is the over concentration of power, the realistic reason is the weak supervision of power, the legal reason is the imperfection of legal system, the organizational reason is the imperfection of independence of supervision. The guarantee of effective power supervision is to smooth the flow of the supervision of information. The precondition is the reae sonable distribution of power and the exercise of power on the right track of the law. |
