论行政自由裁量

行政自由裁量是行政权力的扩张标志,根据不同标准有不同的种类。自由裁量权的存在有其客观必然性,虽然它必然会导致行政权力的滥用,但不给予行政机关以必要的自由裁量权,行政管理又将无法有效地进行。为防止自由裁量产生负作用,应当从法律原则、立法技术、自律、行使程序、司法审查和相对人参与等方面进行必要的控制。

On Administrative Discretion

Administrative discretion as a sign of outstretched power has different types in terms of varied criteria. The power of discretion lies on objective inevitability though its existence is to lead to the abuse of administrative power. However, administration couldn't be carried out effectively if administrative organs were deprived of necessary discretion. For fear that it brings about any side effect, rational control should be given to discretion by way of legal principles, legislative techniques, administrative organs, administrative procedures,judicial reviews and the participation of the administered.
