| 摘 要： | “为他人谋取利益”在受贿罪中的构成地位、性质和认定标准,向来是受贿罪适用中争论的焦点。可以借鉴国外立法体制并结合我国实际,从立法科学严谨,严密刑事法网,严格刑事责任的角度,对受贿罪的构成要件进行合理的重构,以完善受贿罪的规定。

| Abstract: | "Seeking gains for others", is always a focus for debate in the implementation of crime of bribery on the aspects of its constitutional status, nature and establishment standard. Some helpful foreign legislative systems may be borrowed to combine with our country's reality, so as to reasonably reconstruct the constructive components for crime of bribery in the purpose of improving the regulations for it from such angles as: to establish a scientific and serious legislation, to tighten up criminal law nets and to observe strict criminal responsibilities. |
