摘    要:劳动权是劳动法学的核心范畴 ,强化对劳动权范畴的深层次探究 ,既是劳动法学学科发展的理论任务 ,也是劳动法制建设的现实需求。劳动权构造的“权利群”现象、主体利益需求的多样性以及义务对应的多元化都决定了劳动权属性的多重性、复杂性 ,也决定了劳动权必然具有多重的精神意蕴 :生存理念与发展理念相并行 ;社会权属性与自由权属性相兼容 ;物质利益与人身、人格利益相统一 ;倾斜保护与平衡协调相结合。比较而言 ,劳动权范畴中的发展理念、自由权属性、人格法益、平衡协调机能往往被忽视 ,应该突出予以阐释和强调。

Abstract:The concept of labor rights is the core category in labor law. Strengthen the in-depth research of labor rights has both theoretical and practical significance. The fact that labor rights embody a group of rights,and whose subjects have diverse requirements of interests thus the obligations corresponding those rights are different determines that the nature of labor rights is various and sophisticated,and that the inner substance of labor tights is layered. The essence of labor rights should be the parallel notion of survival and development,the incorporating of societal natural and personal liberal nature,the integration of material benefits and individual dignity,the collaboration of favor protection and balance making. Comparatively,the notion of development,the nature of liberal rights,the benefit of dignity and the coordination mechanism in labor rights are often ignored,therefore,they should be emphasized.
