秘密侦查立法规制新探

秘密侦查，是指以查证犯罪为目的，由国家法定机关依照法定职权和程序实施的，针对严重或采取常规侦查措施难以奏效的犯罪行为，而主动采取的在主观上有强烈的保密意愿，在客观上比较隐蔽，对国家司法、道德信用及公民合法权利造成不同程度侵害的技术性和非技术性侦查行为和措施。秘密侦查作为一种易造成侵权的刑事侦查措施，其合理使用必须以法律监督为前提。

New Study on Legislation of Secret Investigation

Secret investigation is a technical and non-technical action and measure, andit aims to verify crime, is implemented by national legal departments according to tegal powers and authorities of office and procedures. which is difficult to be worked by routine investigation measures or the Crime is so severe, so it has strong secrecy willing in subjective aspect and damages the national judicature, morality and credit and citizen＇s legal rights and interests in different levels in objective aspect. As a kind of criminal investigation measure which is likely to lead to tort, the useof secret investigation must be in accordance with legal supervision.
