民事再审检察建议实证研究

民事再审检察建议是在实践中长期探索形成的检察监督形式,旨在促使法院对其认为确有错误的生效民事裁判启动再审程序。由于再审检察建议具有时效快捷、节约资源等特点,新民事诉讼法以法律的形式对其进行了明确,将检察建议作为与抗诉并列的监督手段。然而,由于再审检察建议在检察监督中的适用范围、运行机理以及与抗诉程序相协调的技术问题没有得到妥善解决,其实践效果受到诸多限制。通过对全国以及部分地方检察院再审检察建议的考察,有助于发现其在实践中的运行情况,分析其在运行过程中出现的问题及原因,为今后再审检察建议的法律完善和实践操作提供有益建议,确保再审检察建议的良性运转。

Empirical research on civil retrial suggestion

The civil retrial suggestion is a prosecutorial supervision form formed by the long-term exploration in the practice, aimed at prompting the court to start a civil retrial procedure for the wrong civil verdict. As the retrial suggestion has fast limitation, resource conservation and other features, the new Code of Civil Procedure clarified it in legal form, as a means of supervision with protest. However, due to the apphcation scope of retrial suggestion in prosecutorial supervision, operation mechanism and technical issues in harmony with the protest procedures have not been properly resolved its practical effect is subject to many hinitations. Through the expedition of retrial suggestion in national and some local Procuratorate, help find its operation in practice, analyze problems and causes appeared in the course of operation, to provide usefi.d recommendations for the legal improvement and the practical operation of retrial suggestion to ensure the healthy functioning of the retrial suggestion
