论特定范围内的无限度正当防卫

本文分析了现行刑法第20条第3款的称谓——特定范围内的无限度正当防卫、适用条件、与防卫过当的关系及其价值取向,指出特定范围内的无限度正当防卫符合当前客观形势的需要,在秩序优先的前提下,兼顾了公平,是刑法效益观与公平观的和谐统一。针对立法上的缺陷,笔者提出一些建议,以期对理论和实践有所帮助。

On Unlimited Justifiable Defense with the Specific Scope

This essay thoroughly analyses the title of Article 20,section 3 in the current Criminal Law:Unlimited Justifiable Defense within the special scope,its conditions of application,its relations with Undue Defense and the orien- tation of its value,when it points out that this regulation,meets the demands of the current objective situation,and it gives consideration to fairness under the premise of giving priority to order,and it is a harmonious unity of views of bene- fit and fairness.To the defects in legislation,the authors put forward some suggestions on perfecting in legislation in or- der to benefit the theory and practice.
