| 摘 要： | 本文首先介绍了刑法学界关于共同过失犯罪的理论纷争,并进而认为共同犯罪有事实的共同犯罪与法律的共同犯罪之分,而共同过失犯罪则属于事实上的共同犯罪而非法律上的共同犯罪(后者仅限共同故意犯罪).在此基础上,本文逐一分析了共同过失犯罪的具体类型,并较为详细地论述了共同过失犯罪的认定及其定罪与处罚问题.

| Abstract: | This article first introduces several different opinions on the offense of joint negligence in criminal law and then points out there are two kinds of joint offenses, one is the actual joint offenses, the other is the legal joint offenses and offense of joint negligence is part of the former not the latter. Based on this theory, the author discusses,one by one, the detailed categories of offense of joint negligence and explains its determination,criminalization as well as its penalty. |
