| 摘 要： | 新《刑事诉讼法》第270条突破了原《刑事诉讼法》的法定代理人到场制度,将“合适成年人到场制度”正式入法,对保护涉罪未成年人的合法权益和实现程序正义,具有重要意义.但目前该制度仅仅是原则性规定,对合适成年人的主体范围、选任、权利义务及经费、组织保障等方面存在诸多缺陷,需要进一步以制度的形式进行明确和完善.

| Abstract: | Article 270 in the new ＂Criminal Law＂ riginal ＂criminal procedural law＂, and it is officially broke through legal representative of present system in the o- brought ＂appropriate adult system＂ into the law. To protect the lawful rights and interests of involved crime minors and realize the procedural justice, it is of great significance. But, at present, the system only principled provisions, the appropriate scope of the body of the young people, se- lection, rights and perfect in , obligations and funds, organization guarantee, etc, are still of many defects, which need to clear the form of a system. |
