| 摘 要： | 犯罪的中止形态在多数情况下是单独存在的,但在一定情况下可能与犯罪既遂、犯罪未遂和犯罪预备等犯罪停止形态发生竞合关系。当犯罪中止与犯罪既遂、犯罪未遂和犯罪预备发生竞合时,一般情况应按中止犯罪来处理比较合理恰当。
