| 摘 要： | 监视居住这个颇具中国特色的刑事强制措施,由于其监视的内涵难以界定,在适用条件设置上违背了比例原则,不利于保障人权,同时由于其适用上又需要极高的司法成本,因此,在未来的《刑事诉讼法》修改中其命运应是予以废除。

| Abstract: | The system of surveillance of residence,a compulsory measure with Chinese characteristic,should be abrogated in the coming amendment of criminal procedure law based on the following reasons: 1.It is hard to define its content;2.It disobeys the principle of proportionality on its applied conditions;3.It has a great disadvantage to safeguard human rights and the judicial cost is high. |
