| 摘 要： | 我国商事司法实践中仍存在着颇为严重的法律适用困境,主要表现为"无法可用"的司法困境、"有法不宜用"的司法困境以及"有法不好用"的司法困境。为纾解这种司法困境,除应从整体上思考我国商事立法体系的完善方案外,还应认真探索我国商法的价值、理念、原则体系及其内在逻辑,以便为我国商法立法体系的完善及法律适用的规范化提供理论支撑。

| Abstract: | Much difficulty exists in application of law in China’s commercial judicial practice,such as "no law available," "existing law inappropriate" or "inconvenience to invoke existing law." To solve it,apart from laying out a comprehensive program of commercial legislation,the value,philosophy,principles and intrinsic logic of China’s commercial law should be taken into account so as to build up a theoretical framework to improve commercial law and its application. |
