| 摘 要： | 通过对CIETAC一则案例的评析,研究了CIF合同下买卖双方的义务以及开证行拒付留单后CIF合同的履行方式,探讨了在中国法律及<联合国国际货物销售合同公约>的环境下CIF合同的性质,认为CIF合同仍然是货物交易而不是单据交易.

| Abstract: | This article is to study how CIF contracts shall be further performed after the issuing bank has rejected but still holds the documents under either Chinese law or CISG via deliberate analysis of a CIETAC award. The nature of CIF contracts is also to be visited in this article with the conclusion that CIF is still of goods rather than document. |
