完善交通肇事后逃逸行为刑事立法的构想

域外对交通肇事后逃逸行为设置有＂遗弃罪＂、＂不救助罪＂、＂交通肇事逃逸罪＂等不同罪名,理论界有在我国刑法中增设＂交通肇事逃逸罪＂、＂逃避交通肇事责任罪＂、增设＂特殊遗弃罪＂、设置＂交通肇事逃逸致人死亡罪＂之不同建议。文章提出的完善有关交通肇事后逃逸行为的立法构想,主要涉及到对现行刑法第133条的修改和增加规范交通肇事后逃逸行为的新条款两方面内容。
