代理授权行为诸问题研究

意定代理中授权行为的独立性是一个被前人发现的客观事实,授权行为的独立性问题是探讨授权内无因性的前提。授权行为究竟应是单方行为,还是法律行为,此已被我国法律所确定。为了保障交易安全、促进交易的顺利进行,平衡被代理人与第三人的利益,并且使得授权行为独立性避免受到授权行为有因性的干扰,应当采取授权行为的相对无因说。
